1. Introduction
These Terms of Service apply to all users of the dwellSDA website and anyone engaging our Specialist Disability Accomodation (SDA) services. dwellSDA is an NDIS Registered Provider operating under the National Disability Insurance Scheme Act 2013 (Cth). By using our website or services, you agree to these Terms in full.
2. Definitions

"Services" means all services provided by dwellSDA, including consultation, design, construction and delivery of SDA modular homes.

"Participant" means an NDIS participant seeking Specialist Disability Accomodation.

"User" means any person accessing our website or enquiring about our services.

"SDA" means Specialist Disability Accomodation as defined under the NDIS.

"Agreement" means any formal contract entered into between dwellSDA and a client for the delivery of Services.
3. Services
dwellSDA provides modular SDA housing solutions designed to meet the NDIS SDA Design Standards. Our services include:

Initial consultation and eligibility assessment.

SDA design and customisation in accordance with your NDIS plan.

Modular home construction and delivery.

Coordination with support coordinators, SIL providers and NDIS planners.

Post delivery support and warranty services.
All services are subject to NDIS eligibility, funding approval and the execution of a formal Agreement. Engagement of our Services does not guarantee NDIS approval or funding outcomes.
4. Eligibility & NDIS Requirements
To engage our SDA services you must:

Be a participant in the National Disability Insurance Scheme (NDIS)

Have SDA funding approved in your NDIS plan.

Meet the SDA eligibility criteria as determined by the National Disability Insurance Agency (NDIA)
dwell SDA does not make eligibility determinations on behalf of the NDIA. We recommend working with your support coordinator or NDIS planner to confirm your SDA funding before engaging our services.
5. Enquiries & Consultations
Submitting an enquiry or booking a consultation does not create a binding contract or obligation on either party. A formal Agreement will only exist once both parties have executed a written contract.
During consultations, we will collect personal information in accordance with our Privacy Policy. All information shared will be treated confidentially and used solely to assess and deliver appropriate housing solutions.
6. Pricing & Payments
Pricing for our SDA modular homes and services will be outlined in your formal Agreement and may vary based on:

SDA design category (Improved Liveability, Fully Accessible, Robust, High Physical Support).

Home size, location, and customisation requirements.

Site preparation and installation requirements.
Payment terms, milestones, and conditions will be specified in your individual Agreement. All pricing is in Australian Dollars (AUD) and includes GST where applicable. We do not charge fees for initial enquiries or consultations.
7. SDA Design Standards Compliance
All dwellSDA modular homes are designed and constructed to meet the NDIS SDA Design Standardrequirements applicable to the relevant design category. We maintain compliance with:

The SDA Design Standard (as amended).

The National Construction Code (NCC).

Relevant Australian Standards for accessibility and habitability.

The Disability (Access to Premises — Buildings) Standards 2010.
Design category compliance is certified at the time of delivery. Any modifications made by the participant or their representative after delivery may affect compliance and are undertaken at the participant's risk.
8. Warranties & Liability
dwellSDA warrants that our modular homes will be constructed in a proper and workmanlike manner using quality materials. Specific warranty terms, periods, and conditions will be detailed in your Agreement
To the extent permitted by law:

dwellSDA's liability for any claim arising from our Services is limited to the value of Services provided.

We are not liable for indirect, consequential or special damages arising from your use of our Services.

We are not responsible for delays or failures caused by factors outside our reasonable control, including NDIA decisions, supply chain disruptions or force majeure events.
Nothing in these Terms limits rights you may have under Australian Consumer Law.
9. Intellectual Property
All contents on the dwellSDA website, including text, images, graphics, logos and designs, is the intellectual property od dwellSDA Pty Ltd or its licensors. You may not reproduce, distribute or use our content without prior written consent.
Custom home designs created for you remain subject to dwellSDA's intellectual property until full payment is received, as outlined in our Agreement.
10. Website Use
By using our website, you agree to:

Not attempt to gain unauthorised access to any part of our systems.

Not submit false, misleading or fraudulent information.

Not use automated tools to scrape or harvest content form our website.
We reserve the right to restrict or terminate access to our website for any user who breaches these Terms.

Our website may contain links to third-party websites, including the NDIS, government agencies and industry resources. These links are provided for convenience only. dwellSDA does not endorse or take responsibility for the content, accuracy or privacy practices of any third-party websites.
12. Privacy
Your use of our Services and website is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the collection and use of your information in accordance with our Privacy Policy.
13. Complaints & Dispute Resolution
If you have a complaint about our Services, please contact us in the first instance to allow us to the opportunity to resolve the matter.

We are committed to resolving complaints promptly and fairly. If we are unable to resolve a dispute, it may be referred to mediation or the relevant regulatory authority.
As an NDIS Registered Provider, complaints may also be directed to the NDIS Quality and Safeguards Commission at 1800 035 544 or www.ndiscommission.gov.au.
14. Governing Law
These Terms are governed by the laws of Queensland Australia. Any disputes arising form these Terms will be subject to the exclusive jurisdiction of the courts of Queensland, unless otherwise agreed in writing.
15. Changes to These Terms
We may update these Terms form time to time to reflect changes in our services, legal obligations or business practices. Updated Terms will be published on our website with a revised effective date. Continued use of our Services after any update constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
